When Does Stamp Duty Arise in Redevelopment?
Stamp duty becomes applicable at several stages during the redevelopment process. The most important ones are the Development Agreement between the society and the builder, the individual agreements between the builder and each existing member for their new flat, and any agreement for the purchase of additional carpet area by a member.
If your redevelopment involves the amalgamation of plots — for example, when two adjoining societies are being redeveloped together — stamp duty is also applicable on that amalgamation. This is an expense that is sometimes overlooked and can result in legal complications if not paid.
Who Should Pay the Stamp Duty?
This is where the negotiation between the society and the builder becomes critical. In a well-negotiated redevelopment deal, the builder typically agrees to bear the stamp duty on the Development Agreement. For the individual member agreements, the builder may agree to bear the stamp duty for the area equivalent to the member’s original flat, while the member pays stamp duty only on any additional area purchased.
However, there is no fixed rule. Everything depends on the terms negotiated in the Development Agreement. Some builders may try to pass on all stamp duty costs to the members, which is why it is essential to clarify this before signing.
Stamp Duty Concessions for Women
An important point that many society members in Mumbai may not be aware of is that women purchasers are eligible for a concession on stamp duty in Maharashtra. If the new flat is registered in the name of a female member, the stamp duty payable is reduced. This can result in meaningful savings, and families should consider this while planning the registration of their new flats.
The Amalgamation Trap
When multiple societies are being redeveloped together as a single project, the plots are often amalgamated. Stamp duty is payable on this amalgamation, and the amount can be substantial. Society members should specifically ask the builder whether stamp duty on amalgamation has been accounted for and who will bear this cost. If it is not addressed in the agreement, the society could face unexpected liabilities.
